BICC to Foster Dispute Resolution and Enhance Investment in Bahrain
Retired Supreme Court judge Sanjay Kishan Kaul has been appointed a member of the Bahrain International Commercial Court (BICC) by King Hamad bin Isa Al Khalifa. This prestigious appointment positions Justice Kaul among nine distinguished members of the newly established BICC. Leading arbitrator Jan Paulsson will serve as BICC president, with former British judge Sir Christopher Greenwood as vice president, reported indianexpress.com.
A Platform for International Commercial Disputes
The BICC is a cornerstone of Bahrain’s “Team Bahrain” initiative, aimed at enhancing private sector investment by providing a forum for resolving disputes between parties. The court will exclusively handle international commercial disputes and arbitration-related matters within Bahrain.
Justice Kaul’s Legacy and Achievements

Justice Kaul retired on December 25, 2023, after over six years as a Supreme Court judge. He is renowned for landmark rulings, including his concurring opinion in the 2017 nine-judge bench case that recognized privacy as a fundamental right

He was also part of a seven-judge bench in 2023 that upheld the validity of “unstamped” arbitration agreements, emphasizing the Indian Arbitration Act’s goal of providing “speedy and efficient resolution” to disputes
In his final year, Justice Kaul rejected the Centre’s curative petition to increase compensation for victims of the Bhopal gas tragedy and upheld the Bar Council of India’s authority to conduct the All-India Bar Examination.
Illustrious Career in Law and Judiciary
Justice Kaul’s legal journey began in 1982 after graduating from Campus Law Centre, Delhi University. By 1999, he had earned the coveted designation of senior advocate and served as additional senior standing counsel for the Delhi Development Authority. His judicial career commenced in May 2001 as a Delhi High Court judge. He went on to serve as Acting Chief Justice of the Delhi High Court in 2012, Chief Justice of the Punjab and Haryana High Court in 2013, and Chief Justice of the Madras High Court from 2014 to 2017.
