Indian to be extradited in Oman for murder trial

Haneef, wanted by Omani authorities for this felony, faces charges punishable under Article 302-A of the Penal Code of Oman

An Indian national, Majibullah Mohammad Haneef, is set to be extradited to Oman to face trial for the alleged premeditated murder of an Omani family, including three minor children. The Delhi High Court, presided over by Justice Amit Bansal, has upheld the extradition, considering it a crucial step in the pursuit of justice for the victims, as reported by gulfnews.com.

The incident, which occurred on July 31, 2019, resulted in the tragic deaths of an Omani national, his wife, and their three young children. Haneef, wanted by Omani authorities for this felony, faces charges punishable under Article 302-A of the Penal Code of Oman.

Justice Bansal dismissed Haneef’s petition challenging the Indian government’s decision to extradite him in response to Oman’s request. The court highlighted the existence of an extradition treaty between India and Oman, specifying that individuals accused of offenses punishable under the laws of both countries, carrying a minimum imprisonment term of one year or more severe penalties, are subject to extradition.

In the extradition proceedings, the court took into consideration Oman’s assurance to the Indian government. Omani authorities pledged to ensure a fair and just trial for Haneef, providing him with legal representation and an interpreter. This commitment aims to guarantee his effective participation in both the investigative process and the subsequent trial. The decision reflects the cooperation between India and Oman in addressing cross-border criminal cases and upholding the principles of justice.
