Karnataka woman alleges triple talaq by NRI Husband

NRI husband in Oman accused of issuing triple talaq via registered letter, faces legal action under new marriage protection laws

A 32-year-old woman from Karnataka has filed a complaint at the Brahmavar police station in Udupi, accusing her Non-Resident Indian (NRI) husband—currently employed in Oman—of unilaterally pronouncing triple talaq in violation of Indian law, reported timesofindia.indiatimes.com.

The woman alleged emotional abuse by her in-laws and claimed her husband attempted to end their marriage without consent.

The complainant stated that she married Mohammad Haris on May 24, 2013, in accordance with Muslim customs, and they have a 10-year-old son.

She further alleged continuous harassment from her in-laws—her husband’s father, mother, and brother—who allegedly verbally abused and humiliated her over minor issues, leading to frequent disputes with her husband.

The situation escalated on December 10 last year when her brother-in-law allegedly caused her emotional distress.

  • The woman claimed that the day before the incident, her husband sent a registered letter declaring triple talaq to her residence, her workplace, and to the Honnala Jamaat

  • The move, she contends, was done without her consent and in contravention of the law.

  • The husband is also suspected of planning to marry another woman

Following the complaint, police registered a case under Sections 85 and 3(5) of the Bharatiya Nyaya Sanhita (BNS) and Section 4 of The Muslim Women (Protection of Rights on Marriage) Act, which criminalizes the practice of instant triple talaq in India.
