New Green Card opportunities for Indians

These revisions aim to make the process more transparent and accessible, but experts caution that the impact of these changes will depend on how USCIS applies them in practice

The United States Citizenship and Immigration Services (USCIS) has recently revised its guidelines for the EB-1 visa category, which caters to individuals who can demonstrate extraordinary abilities in fields such as science, arts, education, business, or sports, economictimes.indiatimes.com reported. These updates are particularly significant for Indian professionals in STEM fields, many of whom are shifting to the EB-1A option due to the lengthy wait times associated with EB-2 and EB-3 visas.

As of November 2023, only 140,000 Indians are in line for an EB-1 green card, compared to over a million waiting for EB-2 and EB-3 visas. The updated guidelines aim to clarify the type of evidence required to prove extraordinary ability, providing petitioners with clearer pathways for success.

As the demand for EB-1 visas grows, especially among Indians in STEM fields, these updates could potentially shorten wait times and provide more opportunities for those seeking permanent residency in the U.S.

One key update is the recognition of team awards. Previously, individual awards were the primary focus. Now, if an applicant is named in a team award, it can count toward meeting the evidentiary criteria. USCIS also clarified that memberships in exclusive or prestigious professional organizations will be considered, but applicants must still provide evidence of recent activity to demonstrate sustained acclaim in their field.

Another change pertains to publications. USCIS has removed the requirement for these publications to explicitly demonstrate the value of the applicant’s work, simplifying this criterion for EB-1 applicants. Additionally, the guidelines now allow for “comparable evidence” in cases where traditional exhibitions or showcases may not be applicable, especially for non-artistic fields.
