Considering the seriousness of the matter and the welfare of the children, the High Court issued notices to all parties and scheduled the next hearing within two days
In a tense child custody case, the Gujarat High Court has intervened after a Bhavnagar-based mother alleged that her twin children were taken from her through emotional manipulation, with an attempt to flee the country soon after.
The court issued notices to the Gujarat government, Bhavnagar Police, and the woman’s in-laws while hearing a habeas corpus petition filed by the mother. The matter gained urgency when the court was informed that the father and his parents were intercepted at Jaipur Airport while allegedly trying to travel abroad with the children.
The division bench of Justice Ilesh Vora and Justice R.T. Vachhani took a serious view of the allegations. During the hearing, the court was told that the couple had married seven years ago and later moved to Australia, where the husband and his parents are citizens. The woman, however, remains an Indian citizen.

As disputes continued, the mother moved to her parental home in Bhavnagar with the children. She alleged that the husband and in-laws later requested to meet the twins briefly to seek blessings, assuring her they would return them. Trusting their word, she agreed. However, she claimed they disappeared soon after and stopped responding to calls and video requests.
Fearing that the children would be taken out of India and beyond the court’s reach, the mother approached the High Court. The situation took a decisive turn when authorities intercepted the family at Jaipur Airport.
