High court upholds cheating case against NRI businessman

The court rejected arguments, stating that the existence of a civil proceeding and decree does not preclude a criminal proceeding

The High Court has dismissed a plea to quash a cheating case against an NRI businessman accused of defrauding the Invest Bank of Abu Dhabi of 42.898 million UAE dirhams (over Rs 83 crore).

Justice Bechu Kurian Thomas emphasized that allowing such alleged frauds to go uninvestigated could harm the reputation of Indians in the UAE and others seeking loans from banks.

Rahman contended that the dispute did not amount to cheating and pointed out that the bank had already initiated a civil suit in the UAE, resulting in a decree for repayment.

The case began with a complaint filed by Asin of Thrissur on behalf of Invest Bank to the Chandera police in Kasaragod against Abdul Rahman of Chandera.

It was alleged that Rahman obtained a loan of 68.159 million dirhams (Rs 135 crore) while in the UAE for his business but failed to repay 42.898 million dirhams, violating the loan agreement by using the money to establish businesses under different names in India.
