Understanding the rights and privileges of OCI cardholders

The Overseas Citizen of India (OCI) card, introduced in August 2005, has played a significant role in connecting foreign nationals of Indian origin with their roots. Designed for individuals who were citizens of India on or after January 26, 1950, the OCI card offers a range of privileges, providing flexibility to members of the Indian diaspora while maintaining a balance between rights and restrictions, reported businesstoday.in.

One of the key benefits of holding an OCI card is the lifetime, multiple-entry visa to India. Unlike other foreign nationals, OCI cardholders can enter and stay in India without registering with local police, no matter the duration of their stay. This provides a significant advantage, especially for those who frequently travel between their country of residence and India.

In September 2023, concerns arose among OCI cardholders when some complained about being reclassified as “foreigners.” However, the Ministry of External Affairs quickly clarified that no changes had been made to OCI regulations, reaffirming the privileges enjoyed by cardholders.

With over 4.5 million registered OCI cardholders globally, the largest groups reside in the United States (over 1.68 million), followed by the United Kingdom (934,000), Australia (494,000), and Canada (418,000). The OCI card has undoubtedly become a lifeline for Indian-origin individuals abroad, offering a bridge to their homeland.

As the Indian government continues to balance the rights of NRIs, OCI cardholders, and foreign nationals, the card continues to serve as a vital tool for members of the global Indian community

Amendments and Restrictions

In 2021, the Indian government introduced new amendments to the OCI card regulations. These changes align OCI cardholders with foreign nationals regarding specific permissions and restrictions. For instance, OCI holders must now obtain permits to visit certain protected areas in India, such as Jammu & Kashmir and Arunachal Pradesh. Additionally, they must secure special permissions for engaging in research, missionary work, journalism, or visiting restricted areas.

A significant shift occurred under the Foreign Exchange Management Act (FEMA) of 2003, as the 2021 revisions placed OCI cardholders on the same footing as foreign nationals in matters of economic, financial, and educational privileges. This marked a departure from earlier provisions, which allowed OCI holders to enjoy similar benefits to Non-Resident Indians (NRIs) in these areas.

Eligibility and Exclusions

While the OCI card offers numerous benefits, not everyone is eligible. Applicants with Pakistani or Bangladeshi lineage cannot apply for OCI status.

However, foreign spouses of Indian citizens or OCI cardholders are eligible, provided their marriage has been registered and lasted for at least two years. On the other hand, foreign military personnel are explicitly excluded from receiving OCI cards.
