HC seeks Centre’s response on contempt plea over OCI card

The legal dispute highlights the procedural complexities and jurisdictional boundaries in the issuance of OCI cards, which are vital for individuals of Indian origin seeking long-term residency rights

The Bombay High Court at Goa has directed the central government to file an affidavit in response to a contempt petition filed by advocate Aires Rodrigues. The case revolves around Rodrigues’ pursuit of an Overseas Citizen of India (OCI) card, which has been delayed despite earlier court orders.

Senior advocate A.F. Diniz, representing Rodrigues, informed the court that in July 2024, the high court had instructed the central government to reconsider his client’s OCI card application and issue a decision within 30 days. However, the application remains unresolved, prompting Rodrigues to file the contempt petition.

  • The court found that the FRRO lacked the authority to conduct a preliminary inquiry or decide on the rejection or approval of OCI card applications

  • It ruled that the FRRO had acted without jurisdiction, as it was neither empowered by the central government nor authorized to make such decisions

Central government standing counsel Raviraj Chodankar informed the court that the government is preparing to challenge the high court’s July ruling in the Supreme Court.

The July judgment had annulled a communication from the Foreigners Regional Registration Office (FRRO), Mumbai, which had previously canceled Rodrigues’ OCI card application.
