Federal Court orders fresh review after visa officer failed to properly consider financial evidence submitted by applicants
The Federal Court of Canada has overturned the refusal of visitor visa applications submitted by three Indian nationals, ruling that the immigration officer’s decision was unreasonable.
In a judgment delivered on 1 September 2026, the court ordered that the applications be reconsidered by a different immigration officer. The case centred on concerns about the applicants’ financial circumstances and whether they could support their proposed visit to Canada.
The applicants had submitted detailed evidence of substantial funds and assets belonging to the principal applicant. The financial documents included bank statements and records certified by accountants and banking representatives.
However, the immigration officer questioned the source of lump-sum deposits appearing in the principal applicant’s bank statements. The statements covered transactions between 1 July 2024 and 23 February 2025.
The officer concluded that the applicants had not adequately demonstrated sufficient financial resources for their visit. The court, however, found that the origins of the deposits had been identified in the bank statements and that the officer had failed to properly address the wider financial evidence.

The judgment also highlighted an important distinction between visitors and international students. Unlike students, visitors to Canada are not required by statute to demonstrate sufficient and available financial resources in the same way.
The ruling does not guarantee visa approval for the three applicants. Instead, their applications must be reviewed again by a different officer, taking the court’s findings into account.
The decision may offer reassurance to visitor visa applicants who believe their supporting evidence has not been properly assessed. It underlines the importance of decision-makers addressing significant information submitted during the application process.
India remains a major source of visitors to Canada. According to Canada’s 2025 Annual Report to Parliament on Immigration, Indian nationals accounted for approximately 580,000 admissions under the Visitor Program in 2024, representing about 11.5 per cent of the total.
