NRI couple detained at IGI, gets release order from Delhi High Court

The detention was done based on a Look Out Circular against a complaint registered at Punjabi Bagh police station in 2016

A much-needed relief was granted to an NRI senior citizen and his wife by the Delhi High Court on Monday. The couple was detained at the Indira Gandhi International Airport on arrival from the UK based on a Look-Out Circular (LOC).

The couple immediately contacted a lawyer and made an urgent mentioning before the High Court and challenged the Look-Out circular, Indian Express reported.

The lawyer made an urgent submission and told the court that the couple were accused in a ‘cheating and criminal breach of trust’ case registered at Punjabi Bagh police station in 2016. The case was against a company with which they were in collaboration.

 

“The respondent and all other authorities at the airport are directed to forthwith permit the petitioners to leave the airport if detained in pursuance of the impugned Look-Out Circular.”

The lawyer informed the court that no claim was raised against the couple in the recovery suit filed by the complainant against that company.

Justice Rekha Palli of Delhi High Court heard the case and issued an order. “Till the next date, subject to the petitioner filing an affidavit before this Court not to leave the country without prior leave of this Court, it is directed that no coercive steps be taken against the petitioners on the basis of the subject Look-Out Circular.”

The court issued a notice to the police and asked to list the case for hearing on October 8. “The respondent and all other authorities at the airport are directed to forthwith permit the petitioners to leave the airport if detained in pursuance of the impugned Look-Out Circular,” the court order said.
