Proposed US J-1 Visa Rules Could Tighten Compliance for Indian Researchers and Exchange Scholars

Draft regulations would expand oversight powers and place greater responsibilities on sponsoring institutions if approved

Thousands of Indian researchers, doctors, professors and trainees planning to travel to the United States under the J-1 Exchange Visitor Programme could face stricter compliance requirements after the US Department of State proposed a major overhaul of visa regulations.

The proposed rules are aimed at strengthening oversight of one of the country’s largest academic and cultural exchange programmes. They would give US authorities broader powers to terminate participation in cases of non-compliance while placing additional reporting and monitoring obligations on universities, hospitals and other sponsoring institutions.

Authorities would also gain wider discretion to end participation where programme rules are breached.

Immigration experts say the tighter compliance measures could increase administrative requirements for both institutions and participants, potentially making the application and monitoring process more demanding. While the proposal does not suspend the J-1 programme, applicants may need to pay closer attention to documentation, reporting obligations and programme conditions if the rules are finalised.

The proposal forms part of a broader tightening of US immigration and visa regulations affecting international students and exchange visitors. The draft rules will undergo a public consultation process before any final regulations are implemented, meaning the measures are not yet in force.
