The Punjab and Haryana High Court has taken significant steps in response to a petition filed by a 75-year-old widow and Canadian citizen, Amarjit Kaur Singh, shedding light on alleged wrongdoings involving MLA Sarabjit Kaur Manuke, the state of Punjab, and the Central Bureau of Investigation (CBI). The case, which was reported by Tribune News Service, revolves around claims that the MLA, in collaboration with others, engaged in an attempt to unlawfully seize and take control of Singh’s property through the exertion of undue influence.
Singh, represented by legal counsel PS Ahluwalia, Ishan Gupta, and Keerat Dhillon, submitted her petition before Justice Vikas Bahl’s Bench. In her plea, she asserted her ownership of a residence located in Jagraon. Acting upon information from her daughter-in-law, Singh lodged a complaint, raising concerns about unknown individuals occupying her property and attempting to wrongfully claim ownership. Further investigation revealed that the MLA in question had allegedly taken possession of the house.
It came to light during the proceedings that despite formal complaints detailing potentially actionable offenses, no First Information Report (FIR) had been registered. However, an FIR was eventually filed on June 19, prompted by a statement from Karam Singh.
As the case unfolds, the actions and intentions of the MLA, along with the potential involvement of others, continue to be scrutinized by the Punjab and Haryana High Court, highlighting the importance of a fair and thorough legal process
The FIR acknowledged the petitioner as the rightful owner of the property, referencing a power of attorney dated March 21, 2005. This document was purportedly executed in favor of Ashok Kumar. Singh’s legal representation argued that the power of attorney had been forged and that she had never granted such authority to Ashok Kumar. They contended that Singh was, in fact, a victim in this case. However, the police failed to record her statement or collect her signatures for comparison against those on the alleged forged power of attorney, which could have been vital evidence in proving its fraudulent nature during the trial.
The legal team further highlighted that only Ashok Kumar had been named as an accused party in the FIR. He was subsequently granted anticipatory bail, with the complainant and investigating officer suggesting that the matter had been resolved through compromise.
The underlying strategy of the individuals involved became evident as investigations progressed. Allegedly, a false power of attorney was created in favor of Ashok Kumar, who then purportedly executed a sale deed dated May 11, transferring the property to Karam Singh. The petition underscores the complexity of the situation and raises concerns about the validity of various legal documents presented as evidence.
